Well, folks, there are class action settlements for data breaches, and there are class action settlements for same in California!

Friend of mine told me today that due to new CCPA (California Consumer Protection Agency) laws, companies that handle individuals’ personal data and screw it up face statutory damages of between $100 to $7500 per consumer. Scripps Healthcare has just been caned proper for it’s data breach. As a San Diego Channel put it:

“All impacted patients can claim at least $100 without proving any financial loss due to the data breach. But if you believe you’ve suffered damages as a result of the ransomware attack, you can file a claim for up to $7,500. And whether you file a claim or throw it away, you are still eligible for 36 months of cyber credit monitoring on Scripps’ tab.”

As it affected him AND his wife, they can claim $200 min, plus real damages up to $14,000!

Now this is CLAIMING; actual awards might be weaseled lower.

But this sure beats the $4.01 “Virtual Debit Card” Equifax had to spit out; to even get THAT, you have to turn handsprings, get The Secret Number, run around the house counterclockwise, and touch an object made of wood.

This is a little dated news, but as I have not seen this on this board, I thought I’d post it. At least one state in the union is finally got meaningful penalties on the books; the tide MAY be turning; Stay Tuned!
