• Adobe users revolt over updated terms of use

    A change to Adobe terms & conditions for apps like Photoshop has outraged many professional users, concerned that the company is claiming the right to access their content, use it freely, and even sub-licence it to others.

    The company is requiring users to agree to the new terms in order to continue using their Adobe apps, locking them out until they do so …

    Adobe says that its new terms “clarify that we may access your content through both automated and manual methods, such as for content review.”

    The terms say:

    Solely for the purposes of operating or improving the Services and Software, you grant us a non-exclusive, worldwide, royalty-free sublicensable, license, to use, reproduce, publicly display, distribute, modify, create derivative works based on, publicly perform, and translate the Content. For example, we may sublicense our right to the Content to our service providers or to other users to allow the Services and Software to operate with others, such as enabling you to share photos..

      I cancelled our company’s Adobe products years ago. There are many workable alternatives.

      Hmm…

      So, Mr. Adobe, can you explain exactly how publicly displaying and reproducing my Content would serve the purpose of improving the Services and Software?

      You can stick your terms & conditions where the sun don’t shine.

      I have a graphic artist friend of long acquaintance who belongs to SIGGRAPH, does a lot of CG, 2D, 3D & 3DVR animation who saw this said, “Adobe has been out of control for years. There are just too many free and inexpensive alternative tools out there to put up with this ****.

      “They can kiss my Star-Spangled Banner in Macy’s Window at high noon.”

      That’s what they said…

      This was just a clumsy “clarification” which has now been “re-clarified”:

      After a mini-flareup over a revised Terms of Use agreement, Adobe has clarified that it will not use customer content to train its AI, nor will it in any circumstance claim ownership of customer content that was created with its AI tools.

      More explicitly, Adobe has reiterated two core customer promises:

      Adobe does not train Firefly Gen AI models on customer content. Firefly generative AI models are trained on a dataset of licensed content, such as Adobe Stock, and public domain content where copyright has expired.

      Adobe will never assume ownership of a customer’s work. Adobe hosts content to enable customers to use our applications and services. Customers own their content, and Adobe does not assume any ownership of customer work.

      I recently made the decision to dump Adobe for the very reason they do whatever possible at their end to get into your data, and photos is a huge example. It took a few attempts trying to figure out how to side step their efforts and I managed to succeed somewhat. Nobody actually knows how much they’ve been able to grab even with the customer using caution to avoid giving them more than what they should have. Not even looking back, there are other programs and apps for photo and video editing. The older Adobe software works on my outdated PC and avoids updater. But current Adobe apps and the newer PSE etc. don’t hold any space for me, dodged the bullet when I refused to load PSE 2022 on my MacMini M1 because of a software issue not playing well with others.
